Indian Traders’ Association Act

1. Short title

This Act may be cited as the Indian Traders' Association Act.

1A. Interpretation

In this Act—"Association" means the Indian Traders' Association.

2. Indian Traders' Association

There is established for the purposes of this Act the Indian Traders' Association which shall be a body corporate.

3. Objects of Association

The objects of the Association shall be to—

(a)promote and facilitate, by all lawful means, the trading and commercial interests of its members;

(b)collect statistical information as regards trade generally, print, publish, sell or distribute gratuitously or otherwise, journals, periodicals, books or leaflets, and acquire shares or interests in any journal or periodical, or both, that the Association thinks desirable for the promotion of its object;

(c)make representations to the Government authorities, where necessary, with a view to ensuring fair and equitable distribution of goods among its members, and take every legitimate and lawful step generally conducive to the trading interests of its members;

(d)incorporate into the Association other institutions, societies, or associations having objects in whole or in part similar to any of those of the Association, and co-operate with any person or persons in the furtherance of such objects;

(e)grant financial help to any of its members; and

(f)undertake and carry on all such works as appear necessary to attain the aims and objects of the Association, and do all such things as are incidental or conducive to the attainment of any of them.

4. Committee of Management

The Association shall, subject to its rules, be administered by a Committee of Management consisting of the President, the Vice-President, the Treasurer, the Assistant Treasurer, and all other members to be elected in accordance with the rules of the Association.

5. Powers of Committee of Management

(1)The Committee of Management may, at any of its meetings, held after due notice, by a majority of votes of the members present and voting at such meeting, make rules for—

(a)the admission, withdrawal, or expulsion of members;

(b)the conduct of the duties of the Committee of Management, local committees, office bearers, agents and servants of the Association;

(c)the procedure in the transaction of business;

(d)the election of office bearers of the Association or members of the Committee of Management, or for the appointment of any officer or officers of the Association or any of its branches; and

(e)generally for the management of the affairs of the Association and the accomplishment of its objects.

(a)All rules made by the Committee of Management shall be subject to the approval of a majority of the members present and voting at a general meeting or any other meeting convened for that purpose, as provided for in the rules of the Association.

(b)No such rules shall take effect until approved by an Act of Parliament.

(4)All members of the Association shall be subject to any rules made under this Act.

6. Powers of Association

Subject to section 3, the Association shall have all the powers of a natural person.

7. Dissolution of Association

(1)The Association may be wound up by a decision of 75 per cent of its members.

(2)A majority of members may then decide to transfer the assets remaining after satisfaction of all the debts and liabilities of the Association to some other Indian association within Mauritius with similar objects.

(3)In the absence of any decision by the members of the Association to the above effect, the assets of the Association shall be transferred to one or more Indian charitable institutions in Mauritius as the President thinks fit.

8. Donations and legacies

All donations and legacies made to the Association shall be exempt from payment of any duty.
