Inflammable Liquids and Substances Act

1. Short title

This Act may be cited as the Inflammable Liquids and Substances Act.

2. Inflammable liquids and substances

No inflammable liquid or inflammable substance shall be imported, unloaded, loaded, trans-shipped, transported or kept except in accordance with regulations made under this Act.

3. Regulations

(1)The President may make regulations—
(a)defining the kinds of inflammable liquids and inflammable substances to which the regulations shall apply and dividing inflammable liquids and inflammable substances into classes or categories and making different provisions with regard to such classes or categories;
(b)restricting and regulating the importation, landing, loading, shipping, transshipment, transport and storage of inflammable liquids and inflammable substances;
(c)prescribing a system of registration for the storage of inflammable liquids and inflammable substances, the manner in which applications for any certificate of registration under such regulations shall be made, the authorities which may grant the same, the fees which may be charged, the nature and situation of the premises in respect of which certificates of registration may be granted for the purposes aforesaid, the inspection of premises so registered or in which inflammable liquids or inflammable substances are suspected to be kept, the taking of samples and the testing of inflammable liquids or inflammable substances found thereon, and any other matters incidental thereto;
(d)providing for notice to be given by the owner or master of any ship entering a port with inflammable liquids or inflammable substances, and for ascertaining the quantity and description of any inflammable liquids or inflammable substances on board any such ship;
(e)determining the places at which, and the conditions on and subject to which, inflammable liquids or inflammable substances may be imported, unloaded, landed, stored, loaded or transhipped;
(f)providing for the delivery to such officer as may be specified of samples of inflammable liquids or inflammable substances landed or intended to be landed and for the testing of such samples;
(g)providing, in the case of each consignment which is stated to be of one uniform quality, for the number of samples to be selected, and for the averaging of the results of the testing of those samples;
(h)providing, where the results of the testing of the samples raise a doubt as to the uniformity of the quality of the inflammable liquids or inflammable substances in any such consignment, for the division of the consignment into lots, and for the selection and testing of samples of each lot and for the treatment of the lot in accordance with the results of the testing of those samples;
(i)regulating the description and construction of vehicles to be used in the conveyance of inflammable liquids or inflammable substances by road;
(j)prescribing the conditions subject to which inflammable liquids or inflammable substances may be transported in any one vehicle;
(k)prohibiting or restricting the carriage of goods and passengers in vehicles carrying inflammable liquids or inflammable substances;
(l)prescribing the quantity of inflammable liquids or inflammable substances which may be conveyed at any one time or in any one vehicle;
(m)prescribing the precautions to be observed in the conveyance of inflammable liquids and inflammable substances by road, the manner of packing and the mode and time of transit, and the precautions to be observed in the loading and unloading of vehicles used for such conveyance;
(n)prescribing apparatus for testing inflammable liquids and inflammable substances, the tests to be applied and the manner in which tests are to be made;
(o)fixing fees for the sampling and testing of inflammable liquids and inflammable substances;
(p)appointing officers for the testing and examination of inflammable liquids and inflammable substances; and
(q)generally for the proper restriction and regulation of the import, transport and storage of inflammable liquids and substances.
(2)Regulations made under subsection (1) may provide that any person who contravenes them shall commit an offence and shall, on conviction, be liable to imprisonment for a term not exceeding 12 months and to a fine not exceeding 1,000 rupees, to the forfeiture of the inflammable liquid or in­flammable substance in respect of which the offence is committed as well as of the vessel in which such inflammable liquid or inflammable substance is contained and to the cancellation of the certificate of registration issued in respect of the premises on which the offence is committed.
