Aliens Registration Act

1. Short title

This Act may be cited as the Aliens Registration Act.

2. Regulations for registration of aliens

(1)The President may make regulations—
(a)for requiring aliens residing or being in Mauritius to comply with such provisions as to registration, notification of change of abode or otherwise, as may be made by the regulations;
(b)for the appointment of officers to carry the regulations into effect, and for conferring on such officers such powers as may be necessary or expedient for the purposes of the regulations;
(c)for prescribing the fees to be paid by aliens in connection with their registration;
(d)for determining what nationality is to be ascribed to aliens in doubtful circumstances;
(e)for any ancillary matters for which it appears expedient to provide with a view to giving full effect to the regulations.
(2)Regulations made under subsection (1) may provide that any person who contravenes them shall commit an offence and shall, on conviction, be liable to a fine not exceeding 500 rupees and to imprisonment for a term not exceeding 6 months.

3. Application of regulations

Any regulations made under this Act may relate either to aliens in general, or to any class, category or description of aliens, specified in such regulations.

4. Onus of proof

Where any question arises whether any person is an alien or not, or is an alien of a particular class or not, the onus of proving that that person is not an alien or, as the case may be, is not an alien of that class, shall be upon that person.

5. Jurisdiction of Courts

For the purpose of a trial of a person for any offence under any regulations made under this Act, the offence shall be deemed to have been committed either at the place in which it was actually committed or at any place in which the offender may be.
