Statutory Bodies Mutual Aid Association Act

1. Short title

This Act may be cited as the Statutory Bodies Mutual Aid Association Act.

2. Interpretation

In this Act—"Company" means the Statutory Bodies Mutual Aid Association Limited;"employer" means a statutory body;"local authority" has the same meaning as in the Local Government Act;"member" means a member of the Company;"statutory body" means a local authority, the Central Electricity Board, the Tobacco Board, or an undertaking declared to be a statutory body under section 4.[S. 2 amended by s. 165 (20) of Act 36 of 2011 w.e.f. 15 December 2011.]

3. Assignment of salary

(1)Notwithstanding any other enactment, any transfer, assignment or delegation by a member of a portion of his salary to meet the payment of a loan made, or share issued, to him by the Company in accordance with the by-laws of the Company shall be good and valid.
(2)
(a)Subject to paragraph (c), all sums due by a member to the Company, under any such transfer, assignment or delegation, shall be deducted by the employer from the salary or pension of the member, in accordance with a monthly list of sums so due which shall be forwarded to him by the Chairperson of the Board of Directors of the Company.
(b)The sums so transferred, assigned or delegated shall be deducted in accordance with the by-laws of the Company.
(c)No deduction shall exceed one third of the member's monthly salary or pension.

4. Statutory body

The President may, by Order, declare that any non-governmental statutory undertaking shall be a statutory body.[S. 4 amended by Act 48 of 1991.]

5. Moneylenders Act not applicable

The Moneylenders Act shall not apply to the Company.
