1. Short title

This Act may be cited as the Church of Jesus-Christ of Latter-Day Saints Act.

2. Interpretation

In this Act—"Church" means the Church of Jesus-Christ of Latter-Day Saints es­tablished under section 3;"Committee" means the Committee referred to in section 5.

3. Establishment of Church

(1)There is established for the purposes of this Act the Church of Jesus Christ of Latter-Day Saints.
(2)The Church shall be a body corporate.

4. Objects of Church

The objects of the Church shall be—
(a)to promote the interests of its members in matters of—
(i)faith and spirituality;
(ii)morality and honesty;
(iii)family unity and stability;
(iv)citizenship and the observance of law and order;
(v)education, arts and sciences;
(vi)industry and self-reliance;
(vii)economic independence and stability;
(viii)brotherhood, fraternal love and respect;
(b)to promote and advance the study of its doctrines, disciplines, practices and scriptures;
(c)to promote the interests of its members and in particular, to build, operate and maintain places of worship and such other buildings and facilities as may be necessary or convenient for the purposes of the Church.

5. Management

(1)The management of the Church and the exercise of any of its powers shall vest in a Committee composed of such number of members as may be prescribed.
(2)Notwithstanding the provisions of subsection (1), the members of the Committee shall, unless otherwise prescribed, be the persons specified in the Schedule.
(3)The registered office of the Church shall be at such place as the Committee may from time to time decide.

6. Donations and legacies

Article 910 of the Code Civil Mauricien shall not apply to the Church.

7. Exemptions

Notwithstanding any other enactment—
(a)the Church shall be exempt from the payment of duty on dona­tions and legacies made to it;
(b)no stamp duty or registration fee shall be payable in respect of any document under which the Church is the sole beneficiary.

8. Regulations

(1)The Committee may make such regulations as it thinks necessary for the purposes of this Act.
(2)Notwithstanding the Interpretation and General Clauses Act, regula­tions made under subsection (1) shall not be required to be­—
(a)approved by the Minister;
(b)laid on the table of the Assembly;
(c)published in the Gazette.

9. Saving

Nothing in this Act shall prejudice or affect the rights of the State or any body politic or corporate, or any person or persons, except such as are men­tioned in this Act and those claiming by, from, through or under them.[S. 9 amended by Act 48 of 1991.]
