Vandermeersch Street Bridge Act

1. Short title

This Act may be cited as the Vandermeersch Street Bridge Act.

2. Interpretation

In this Act—"Atrium Building" means the commercial complex to be put up by the Company or any person in the rights of the Company;"Company" means Li Sung Sang Properties Limited;"Minister" means the Minister to whom responsibility for the subject of lands is assigned.

3. Permission to build footbridge

(1)The Company may build a footbridge, in the manner specified in the Schedule, for the purpose of connecting the Atrium Building with Place Cardinal Margeot Bus Station in the Town of Beau Bassin-Rose Hill.
(2)The Company shall, at its own cost, maintain the footbridge in good repair and ensure that it is not a source of danger to the public.

4. Withdrawal from public domain

(1)The footbridge—
(a)shall not form part of the public domain; and
(b)shall be the property of the Government of Mauritius.
(2)That part of the road underneath the footbridge shall continue to be dedicated to public use.

5. Annual fee

(1)The Company shall, on 1 July in every year, pay to—
(a)the Government such fee as the Minister may determine; and
(b)the Municipality of Beau Bassin-Rose Hill such dues as may be prescribed by the Municipal Council.
(2)The fee and dues provided under subsection (1) may be revised after every period of 5 years.

6. Amendment of Schedule

The Minister may, by regulations, amend the Schedule.

Schedule (Section 3 (1))

The footbridge shall be—
(a)at a distance of 77.50 meters from the junction of Vandermeersch Street with Royal Road;
(b)at a height of 7.6 meters above Vandermeersch Street;
(c)of a length of 20.35 meters and a width of 2.4 meters;
(d)of such construction and design as the Minister may approve.
