Queen Elizabeth II Avenue, Port Louis (Authorised Construction) Act

1. Short title

This Act may be cited as the Queen Elizabeth II Avenue, Port Louis (Authorised Construction) Act.

2. Interpretation

In this Act—"Company" means the State Bank Realty Ltd, incorporated in Mauritius on 30 June 1987;"Land" means the State Land at Queen Elizabeth II Avenue, Port Louis;"Minister" means the Minister to whom responsibility for the subject of land use is assigned.[S. 2 amended by Act 48 of 1991.]

3. Permission to build

(1)The Company may, subject to such conditions as the Minister may impose, build columns, canopies, and projecting galleries along the frontage of the Land onto Queen Elizabeth II Avenue, Port Louis.
(2)The Company shall, at all times and at its own cost, maintain the colonnade, canopies and projecting galleries in good repair and ensure that they are not sources of danger to the public.

4. Public domain

(1)The colonnade and canopies referred to in section 3 shall form part of the public domain.
(2)The projecting galleries shall not be part of the public domain.
(3)The pavement under the canopies constructed on the Land shall continue to be dedicated to public use.

5. Annual fee

(1)The Company shall, on 1 July in every year, pay to the Government of Mauritius and to the Municipal Council of Port Louis such fee as the Minis­ter may determine.
(2)The fee payable under subsection (1) may be revised every 5 years.
