Butte à Tonniers Stream (Authorised Construction) Act

1. Short title

This Act may be cited as the Butte à Tonniers Stream (Authorised Con­struction) Act.

2. Interpretation

In this Act —"Company" means Pick-n-Eat Ltd, incorporated in Mauritius on 16 De­cember 1983, and includes any lessee of the land;"land" means that part of the Butte à Tonniers Stream described in the Schedule;"Minister" means the Minister to whom responsibility for the subject of land use is assigned.

3. Permission to build

(1)The Company may, subject to such conditions as the Minister may impose, construct a building on the land.
(2)The Company shall, at all times and at its own cost, maintain the building in good repair and ensure that it is not a source of danger to the public.

4. Public domain

(1)The building constructed shall not be part of the public domain.
(2)The part of Butte à Tonniers Stream underneath the authorised con­struction shall continue to form part of the public domain.

5. Annual fee

(1)The Company shall, on 1 July in every year, pay to the Government of Mauritius and to the Municipal Council of Port Louis such fees as the Min­ister may determine.
(2)The fees under subsection (1) may be revised every 5 years.

Schedule (Section 2)

Butte à Tonniers Stream

Downstream along the Butte à Tonniers Stream for a length of 24 metres from the bridge at Chaussée Street.
