Mauritius Family Planning and Welfare Association (Temporary Provisions) Act

1. Short title

This Act may be cited as the Mauritius Family Planning and Welfare Association (Temporary Provisions) Act.

2. Interpretation

In this Act—"Association" has the same meaning as in the existing Act;"existing Act" means the Mauritius Family Planning and Welfare Association Act;"existing Committee" means the National Executive Committee set up under the existing Act;"General Meeting" has the same meaning as in the existing Act;"interim Committee" means the interim Management Committee set up under section 3(1);"Minister" means the Minister to whom responsibility for the subject of health is assigned.

3. Interim Committee

(1)There is set up an interim Management Committee of the Association which shall consist of—
(a)a representative of the Ministry, who shall be the Chairperson;
(b)a representative of the International Planned Parenthood Federation; and
(c)3 other suitable persons to be appointed by the Minister after consultation with the International Planned Parenthood Federation.
(2)The existing Committee is suspended and the interim Committee shall have and exercise all the powers necessary to manage the Association, including the powers vested by the existing Act in the existing Committee.
(3)The Chairperson of the interim Committee shall have and exercise all the powers vested by the existing Act in the Chairperson of the existing Committee.
(4)
(a)The interim Committee shall exclusively be vested with the power to call a General Meeting of the Association.
(b)Notwithstanding paragraph (a), the interim Committee may, if it thinks fit, exercise any of the powers vested by the existing Act in the existing Committee, in relation to a General Meeting of the Association.
(5)The interim Committee may fix its quorum and shall conduct its meetings and other proceedings in such manner as it considers appropriate.

4. Application of Act

This Act shall have effect notwithstanding anything to the contrary in the existing Act.

5. Termination of Act

This Act shall cease to have effect on a date to be fixed by Proclamation.
